November 10 in Vorša court judge Ina Kokhova punished BPF Party member Vitaly Pavlov fine of two basic units for "using obscene language" in a polling station during the current parliamentary campaign. The behavior of the opposition activist has been qualified as an administrative offense under Article 17.1 of the Administrative Code ("Petty hooliganism").
The basis for this court decision were the events that took place on September 11 at the polling station №6, which is housed in the premises of secondary school #5 of Vorša, where the director is working chairman of the precinct election commission Natalia Voitsekhovitch.
Before the start of the counting of votes by the observer BPF Vitaly Pavlov drew the attention of the chairman of the fact that according to the law, one side of the table should remain open to observers viewing. Natalia Voitsekhovitch expressed their dissatisfaction, but the remark of party activists listened.
It seemed that the conflict has been settled on this. But the next day, Vitaly Pavlov, was detained by police at the railway station and placed in a temporary holding cell. The reason for the detention was the statement by the chairman of the election commission, which she wrote in the executive committee during the delivery of ballot papers, listened to the advice of colleagues. According to the statement, the observer allegedly behaved hooligan: insulted the chairman of the commission and foul language.
At the trial the applicant's words about misconduct Vitaly Pavlov confirmed at the polling station election commission member, teacher, school psychologist №5 Lyudmila Lazareva, subordinate to the chairman of the commission – the school principal.
However, Vitaly Pavlov did not agree with the charges against him, describing them as far-fetched. He said that no one was offended and did not interfere with the work of the Commission, since otherwise it would have stopped the action at the present site of the policeman.
Two other invited to the court witnesses who were present that evening in the area that do not depend on the work of the school director, could not shed light on the situation and make a picture of what happened more understandable. Thus, the first of them, Emergency Situations Ministry officer, testified that there was a considerable distance from the place of the conflict and did not hear anything. A police officer does not appear on any one trial. The last time, according to his direction sent by the official paper, during the trial, he participated in the brigade duty in the village Kopyś.
On a final decision judges are not influenced by any shortcomings in the preparation of the report, which lacked the time and place of the offense or the fact that witnesses at the trial were subordinate Natalya Voitsekhovitch.
Despite the fact that Vitaly Pavlov said the case was fabricated, to appeal the decision on it in the regional court he does not going to, because it has not been a single positive example, whenever a higher court sided with the opposition representatives.
