To reinstate Oksana Mushkat and to pay her compensation in the amount of more than eight million Belarusian rubles – such is a decision passed by judge of Hłybokaje District Court Stanislav Trapuk against Hłybokaje housing and communal services.
Oksana Mushkat, worker of Hłybokaje housing and communal services, fired for absenteeism. Because it is becoming the visually impaired while working in utilities, began to fight for the right to lighter conditions.
Muscat Oksana says: "I have lost all hope, because I thought that it makes no sense to sue state agencies. And I am very grateful to judge Trapuk that justice finally triumphed."
As explained by Judge Stanislav Trapuk, in fact there were many inconsistencies in the documents and the arguments of the plaintiff by the defendant fully have not been challenged: "The decision about her dismissal from work due to truancy taken without proper and detailed consideration of all the circumstances of her absence. In addition, the employer did not take into account, as provided for by Article 283 of the Labor Code and the Law on Social Protection, in the period of individual rehabilitation program is not permissible dismissal at the initiative of the employer."
