On June 9, in the court of Zheleznodorozhny district of Viciebsk, judge Alla Bordyukova continued her consideration of the administrative case of Nadezhda Kukonos, an activist of "Honest Power", who was accused of insubordination and insult of a police officer while performing his official duties (Code of Administrative Violations, Article 23.4 and Article 23.5).
The injured person was Yevgeny Katskevich, the police major of the Zheleznodorozhny district police department.
According to the first militia protocol, on June 5, the citizen Kukonos, who was in the building of the Zheleznodorozhny district police department, did not obey the multiple legal requirements of the senior operative major Major Katskevich, who forbade her to videotape the duty unit on her mobile phone. Banned on the grounds that video recording in the police station allegedly does not permit legislation. Responsibility for this offense is provided for in Article 23.4 of the Code of Administrative Offenses.
The second protocol claims that, after being detained for an offense, the citizen Nadezhda Kukonos deliberately began to insult the police major Yevgeny Katskevich: he spat on his face and on uniforms, but did not react to the comments. Thus, by her actions she allegedly violated Article 23.5 of the Code of Administrative Offenses.
Nadezhda Kukonos did not agree with the contents of the protocols and she said that she would not give any explanations about her behavior after interviewing the witnesses and watching the video from the police video surveillance cameras.
As witnesses, employees of the Railway police department Gennady Baturin, Ruslan Lysenok and Kirill Bespalov spoke. All of them confirmed the version fixed in the protocols and expressed by Major Katskevich: did not submit, resisted, spat, insulted, imitated a poor state of health.
The main evidence of an administrative offense was to be a video from surveillance cameras, so it aroused the interest of those present at the trial. And although the quality of the video was good, an unpleasant circumstance was the complete absence of sound. So, the video showed that Ms. Kukonos was using physical strength, she resisted, made gestures in the direction of the attendant, resembling spits, but what exactly caused this behavior was incomprehensible because of the lack of sound.
After watching the video, Nadezhda Kukonos stated that, in her opinion, the video is mounted, and it is not clear if she was shooting on her mobile phone. However, later she said that she could have videotaped it, but it's all in the mobile phone, which itself jumps from one function to another. So, the video shows that the phone works, but initially she turned it on with the aim to demonstrate the fact of beating of two drunken citizens recorded by police last week, which she accidentally witnessed. And she came to the ROVD for the sole purpose: to learn about the fate of her statement, which she wrote about the beatings of these citizens. She also said that the only reason for her being sent to the temporary detention center was the fact of police lawlessness, which she fixed on her phone.
Before the ruling on the case, the judge made a break. After the break, the people in the hall became smaller. Nadezhda Kukonos did not return to the hall. After several formal actions, Judge Alla Bordyukova announced that to study the evidence base in the actions of Nadezhda Kukonos, the court saw the composition of the administrative offenses provided for in articles 23.4 and 23.5 of the Code of Administrative Offenses.
The court decided, under Article 23.4, to pay a fine in the amount of 15 basic units from Nadezhda Kukonos, and according to Article 23.5 – 25 basic values. On the aggregate, the penalty was 40 basic for the amount of 920 rubles.
