Vitebsk resident Alexander Cholad addressed to the chairman of the Supreme Court Valentina Sukala complaint. In his address, the Chief Judge Chill reports of arbitrary leaving the country without considering the deputy chairman of the Supreme Andrei Zabara and first deputy chairman of the Supreme Alexander Fedortsova its supervisory appeals to a court of Vitebsk Railway and asks to restore his constitutional right of access to court.
Referring to the Supreme Court, Alexander wanted to cancel Cholad unfair, in his opinion, the judgment of Vitebsk Railway, issued in January 2013. According to the ruling, Judge Svetlana Vorotynskaya in closed court hearing granted a civil action for the protection of honor, dignity and business reputation of the former director of secondary school number 27 Vitebsk Irina Isachenko. According to the verdict, was ordered to pay Cholad I. Isachenko monetary compensation for moral damages in the amount of 3 million and other costs of the court and the plaintiff in the amount of 2.5 million rubles.
But Mr. Frost did not agree with the court decision. He argues that he had no intention to humiliate the honor, dignity and business reputation I. Isachenko when treated with written statements to the newspapers " Zvezda", "Sovetskaya Belorussia" and the Administration of the President. However, neither the court of cassation, or supervision by the Chairman of the Vitebsk Regional Court Nicholas Hamichenka not revealed in the actions and judge ruled Vorotynskaya violations of current legislation and left it unchanged, and the complaints of Cholad dismissed.
Deputy chairman of the Sun Andrew Zabara and first deputy chairman Alexander Sun Fedortsov generally refused to consider the supervisory review Vitebsk activist for the reason that, in their opinion, in the texts of his complaints insulting words and expressions. Moreover, the complainant was warned Fedortsova that in the future in case of sending them to the Supreme Court appeals and complaints containing abusive or defamatory language towards justice or individual judges, correspondence with him will be entered into.
However, the current Constitution of the Republic of Belarus and a number of international treaties directly points to an invalid deprivation of Belarusian citizens access to justice. Indeed, without access to the courts can not be the rule of law, which is a measure of civilization and development of the judicial system of any country.
Based on this, Alexander Cholad sent complaint to the chairman of the Supreme Court of Belarus Valentin Sukalo with the hope that the Chief Justice of the country, like anyone else, understands the importance of citizens' access to a fair, independent and competent court. This understanding will lead to the abolition of unfair judgments and consideration to his extraordinary appeal in the Supreme Court of the Republic of Belarus.
