Oktyabrsky District Court of Vitebsk recognized owner of the site www.gorodvitebsk.by guilty of copyright infringement and fined him 3,750,000 rubles.
As reported in the reasoning of the court decision, the individual entrepreneur Andrew Lapin used photos from the site www.vitebsk.biz, belonging to another individual entrepreneur - Christina Romanov replaced the logo on them one site to others and posted on its portal.
These pictures were taken by Christina Romanov during the opening of the restaurant "Cornflowers" and posted on the website www.vitebsk.biz under contract with the owner Artem Laboda.
After studying the material and after hearing the representatives of the parties, the court found Andrew Lapin guilty of an offense under Article 9.21 of the Administrative Code "Violation of copyright, related rights and patent," and fined the entrepreneur to 3,750,000 rubles, though the sanction of the article provides for individual entrepreneurs a fine of 20 to 100 basic units.
Andrew Lapin considered unjust verdict and appeal to the Vitebsk regional court. However, the judge Lapshova after the complaint has left the decision of the district court, and the complaint dismissed entrepreneur. Mr. Lapin said he intends to appeal this decision, now - in the Supreme Court.
