Jan Dzyarzhautsau and his fellow party member Peter Sarapenya fed to the chairman of the administration of Pervomaisky district of Vitebsk statement picket November 7, 2014. Party activists during picketing supposed to inform the Vitebsk citizens about the consequences of the Bolshevik October revolution and the need to ban the Communist Party and its ideology on the territory of Belarus. The application was filed in a timely manner and in compliance with all necessary formalities. However, despite this, a picket was prohibited.
The next day, after receiving a response №15-16 / D-8 of the district administration to ban declared picket Jan Dzyarzhautsau filed a complaint in the Vitebsk Regional Executive Committee. In the complaint, Mr. Yang drew attention to the "gross violations of applicable law by the senior officials of the administration of Pervomaisky district of Vitebsk", resulting in the violation of the rights and legitimate interests of citizens.
Firstly, the response was not signed by the Deputy Head of Administration Olga Gurchenko, and hence had no legal force. And secondly, the response was sent to the applicant with a delay of at least a day, which is a violation of Article 6 of the Law "On mass events in Belarus." In a statement to the Executive Committee Jan Dzyarzhautsau asked "to bring to justice officials responsible for violations of the current legislation."
In a letter of Vitebsk Regional Executive Committee, which was signed by Alexei Matyushko business manager, reported that "in accordance with the third paragraph of paragraph 1 of Article 15 of the Law of 18 July 2011," On the complaints of citizens and legal entities, "the complaint is left without consideration" because it is "subject to judicial review."
This answer did not satisfy the applicant and he filed another complaint - the prosecutor's office of Vitebsk. In its regular complaint Jan Dzyarzhautsau requested to apply to the clerk Gurchenko measures prosecutorial response, since that violate applicable law and its legitimate interests and rights.
