Sixteen year old resident of Viciebsk turned to the UN Committee on Human Rights with a complaint against the Republic of Belarus for violation of their rights, the human rights activist told BelaPAN Pavel Levinau (pictured), who assisted in the preparation of the complaint.
Levinau explained that in December 2014 the girl right out of school without explanation was taken by unknown people and taken to a shelter.
"She refused to go. She was threatened that if she did not go, it will be placed in a psychiatric clinic – human rights activist said. – She was kept in the shelter without any judicial decision, only on the basis of the Commission's decision of the juvenile administration of the Soviet district of Viciebsk. Although the Constitution says clearly that to remove the child from the family is possible only by court order."
According Levinau, the court held only July 13, 2015, and ruled that depriving parental rights parents of the girl child and no reason to be returned to the family. She was able to return home only at the end of July 2015.
He said that the girl turned to the prosecutor of Viciebsk with a complaint about a violation of her right to security and privacy, but he refused to go to court with a lawsuit in defense of its rights. Then she tried to independently sue, but first of it demanded payment of state fees for filing a complaint, and then the court stated that the cases of infringement of the rights of jurisdiction to the court. According Levinau, higher instance courts have upheld this position.
In this regard, the girl decided to go to the UN Human Rights Committee. "The complaint was sent today [1 June], – said Levin. – About two weeks it will go there. Then, within a month or two there will be to decide whether to accept it for consideration. I think that it will be adopted."
Regarding the timing of the complaint, said Levinau, it is usually about three to five years. "Complaints, unfortunately, considered not as fast as we would like," – he said.
