Draft decision of the Połacak District Council of Deputies was imposed on the 17 session of the regional council chairman of the primary organization of the Free Trade Union of Workers of JSC "Połacak-Fiberglass" Victor Stukov. However, the district council refused to consider the proposed trade union leader of the project, and a decision on the establishment of social partnership and the implementation of the Belarusian government obligations was not accepted.
Belarusian Free Trade Union (BFTU) attempts by local governments induce Director of JSC "Połacak-Fiberglass" to carry out the decree of the president and a general agreement with the government to eliminate discrimination on the grounds of the plant's workers for their participation in the union.
Belarus Law on Local Government stipulates the right of citizens to make reasoned draft decisions of local councils. Moreover, these draft decisions should always be considered and the results of the regional council session review to be published in the newspaper.
Representing the interests of workers
Chairman of the primary SPB asked the district council to adopt the following decision:
Implementing the recommendation of the International Labour Organization (ILO) on the special attention to complaints of discrimination as a result of cooperation with the ILO Committee, and
Implementiruya paragraph 45 of the General Agreement between the Government of the Republic of Belarus, national associations of employers and trade unions in 2016 – 2018, Połacak District Council DRCIDED:
1. Make sure the employer – JSC "Połacak-Fiberglass" on violations of Presidential Decree of July 15, 1995, #278 "On the development of social partnership in the Republic of Belarus", the inadmissibility of discrimination against workers of similar professions for their participation in the union, and the need for action, excluding such violations.
2. In the period up to 23 April 2016 to include a representative of the Free Trade Union of Belarus Nikolai Sharakh to the commission for collective bargaining and to make additions and changes to the collective agreement, eliminating discrimination against workers based on participation or non-participation in trade unions.
The measures taken to inform the Połacak District Council of Deputies, within one month from the date of receipt of a copy of this DECISION.
This law does not apply
However, the chairman of the Połacak District Council of Deputies Joseph Gribovich decided not to consider the project on the district council session. Thus, he is considered by the Free Trade Union activists had violated the law on local government.
Draft decision District Council and the cover letter from the chairman of the primary organization of the Free Trade Union Mr. Gribovich forwarded to answer the chairman of the Połacak District Federation of Trade Unions FPB Svetlana Yanichek. The free trade unions surprised: Mrs SL Yanichek It has no relation to their trade union and not subordinated by the chairman of the district council Gribovich.
The trade union functionary Yanichek, however, considered it best not to resist the district council and took over the responsibility to answer Free Trade Unions. However, pre-sent a request to the regional association of trade unions of the FPB.
Says Victor Stukov: "During a personal meeting April 6 Svetlana Yanichek she said that the response we have it yet. Because it has sent a request to the regional association of trade unions. Although this question is not to the unions of the FPB, and to the local authorities, who refuse to perform their duties. We will appeal against the actions of the Połacak district council in the regional council of deputies. And, if need be, we will submit a complaint to the district council in Połacak court."
