Statement by the Chairman of the Investigative Committee of Belarus Valentin Shaev Vitebsk resident Peter Ivanov sent on the events that took place more than a year ago. He requested that charges against individuals in civilian clothes, who carried out illegal, in his opinion, inspection of the home, a criminal case under Article 202 ("Violation of the privacy of the home and other legal possessions of citizens") and 426 ("Abuse of power or authority") criminal Code.
IC Chairman Shaev sent a statement to Mr. Ivanov to the investigative committee of the Vitebsk region, from there it was shifted to October (Vitebsk) IC district department. It was the last and take to check on the application. Test result was the decision not to open a criminal case "due to the lack of law enforcement officers in the actions of the administration in October district of Vitebsk regional executive committee of the offense."
Incident with a tour-"search" occurred on 7 January 2012. On the eve of Peter Ivanov handing out leaflets on the streets of Vitebsk in support of Sergei Kovalenko, was detained by police and taken to the detention center. Police officers who conducted the arrest, wrote in the report that John Doe allegedly urged citizens to participate in illegal activities. Later, a new protocol to specify a different reason for detention: swearing. It is a calling, and not the distribution of leaflets, and then retired officer tried and punished by a fine of 4 base units.
According to John Doe, consent to examination of his apartment, he did not give. During the survey asked those who organized, called the data, but they refused. The very same survey, said the naval officer, retired, was made in the form of search, since open door, digging into things. Protocol inspection the Host not found a copy of minutes not given.
Deputy Head of the regional department of the UK Ishchuk, whose signature is at the decision not to open a criminal case, told the author claims that the October district police officers Vitebsk Komar and Alexander Pavlov, Inspected homes, acted according to the law. Before the beginning of the inspection was taken warrants, were invited witnesses. Thus, all allegedly took place in accordance with Article 10:13 procedural Executive Code of Administrative Offences.
Article 10:13 PECoAO really allows for examination of a prosecutor's home without the consent of the owner or the person living in it. But such an inspection is performed only if there is "the existence of reasonable grounds to believe that the inspection can be found traces of an administrative offense, and other material objects, clarified other circumstances relevant to the case of an administrative offense."
Peter Ivanov has been punished by the court under Article 17.1 of the Administrative Code ("petty hooliganism") based on the protocol drawn up by law enforcement, and their testimony. Retired officer allegedly used foul language in a public place. Why was needed "review" of housing to a charge for such an article, which "traces the administrative offense" or "other tangible objects relevant to the case", this "inspection" could help detect - remains a mystery.
