This was stated by Deputy Minister of Labor and Social Protection Igor Starovoitov on February 28 at a meeting of the Council for the Improvement of Labor Legislation. The reason for the control was violation of the General Agreement by the Belkhimprofsoyuz. At the plant, Belkhimprofsoyuz's primary (BHP) refusal to implement the General Agreement and create a unified representation of employees together with the Belarusian Free Trade Union (SPB).
On the workers' side, Połacak-Steklovolokno OJSC has not formed a single commission for all workers for collective negotiations with the employer. In August of this year, the enterprise has to sign a new collective agreement of employees with the employer, which will determine the average salary for the plant for the next three years. BHP does not fulfill its obligations and sabotages the creation of a commission necessary for the employees.
A free trade union of plant workers has long sent a representative to a single commission. And the Belkhimprofsoyuz makes additional requirements for the creation of a single commission (to provide lists of members of the St. Petersburg branch of the plant), which is not stipulated by either the law or the tripartite general agreement (trade unions, employers and government).
Previously, the list of union members working in the factory, demanded from the St. Petersburg employer. Workers refused to show such lists, because they believe that the fact of membership in the SPB refers to the personal data of the employee, who are not subject to disclosure without the consent of the worker. Now the list of members of the Free Trade Union is already being requested by BHP – the answer will be the same.
In a letter to the Belkhimprofsoyuz primary association, signed by the chairman Tatyana Gurova, the address of the primary SPB is: "To consider the possibility of participation in the collective bargaining of the SPB representative, we consider it necessary to provide reliable information indicating the specific employees who are working with the open joint-stock company Połacak– Steklovolokno, whose interests your organization is going to represent in collective bargaining. "
The vice-chairman of the SPB, Nikolai Sharakh, commented on this letter as follows: "I consider this the self-indulgence of Mrs. Gurova, which has nothing to do with the Belarusian legislation. I participated in the meeting of the Council for the Improvement of Labor Legislation under the Ministry of Labor, the secretary of the FPB, Mrs. Hanna Varfolomeeva, also agreed that these demands by Gurova are illegal. And in general, the Council on Legislation under the Ministry of Labor did not find any objection to our refusal to provide the Belkhimprofsoyuz with lists of SPB members working at the plant."
