Civil Division of the Vitebsk Regional Court restored the right of residents of Vitebsk Alexander Antonenko freedom to leave the country. Former chairman of the court decision Oktyabrsky district Eugene Burunova that the right to travel was restricted Antonenko, a panel declared unlawful and set aside.

The story began in April this year when the Department of enforcement (PGI) Oktyabrsky district of Vitebsk went to court, arguing that Alexander Antonenko does not pay money to the state for the maintenance of their child in an orphanage. The judge of the court of Oktyabrsky district of Vitebsk Eugene Burunov agreed with the arguments of PGI and its ruling on April 9 Antonenko restricted the right to travel outside the Republic of Belarus. However, the latter did not agree with the decision of the court and filed a private complaint in the Vitebsk regional court.

In his complaint to Alexander G. he argued that a victim of a miscarriage of justice and asked to cancel as unlawful and unfounded judicial decision. He cited irrefutable facts that the judge Burunov taking a decision on his case, did not consider the absence of debt on payment of the cost of the child.

As of February 1, 2015 the cost of the overpayment in favor of the Department of Education, Sports and Tourism of the Vitebsk City Council is 476 rubles. On April 9, when a judge issues a ruling on the case, the debt is also absent – on the contrary, there was an overpayment in the amount of 31 thousand rubles. That is Mr. Antonenko performed his duties to the state completely, and claims to it should not be.

However, the judge decided Burunov in its verdict and that restricted the right of law-abiding citizen. This demonstrated unparalleled incompetence, undermining confidence and to him as a judge and the head of the district court, and the judicial system as a whole. It was only thanks to the experience and professionalism of the judges of the Vitebsk regional court judicial error has been corrected, and the rights of the citizen were restored.
