December 3rd District Court of Vitebsk Railway deferred previously considered an administrative case Peter Berlinov - a participant in the artistic performance "with birds and cells." And although Mr. Berlinov journalism is not engaged, and to the artistic action in support of freedom of the press joined by chance, he still was charged with Part 1 of Article 23.34 of the Administrative Code (violation of the order of organization or holding mass events).

With the report issued by the chief of department of law enforcement and prevention of the police department of the Railway District of Vitebsk Major Alexander Rybakov, Peter Berlinov is not accepted, and to testify against himself refused, citing article 27 of the Constitution of Belarus.

The prosecution was read all the same mantra about the violation of the order of organizing and holding mass events, intentionally committed "to express their political interests," according to the paper, and objects in the hands photographed located on the background of graffiti. That is enshrined in the photo people "Continuing the theme of graffiti, which symbolizes the pressure on the press," which can be regarded as clear evidence of a mass event. Like all the other gentleman Berlinava identified in the photo is the same Major Alexander Rybakov.

Investigating the case, the defendant gave several explanations regarding his arrest on trumped-up reasons, November 28, which, however, in no way affected the conduct of business.

After reviewing the case, the parties' submissions, the judge ruled Elena Tsygankova: administrative arrest for a period of three days, which shall be credited to the stay of Mr. Berlinov in the temporary detention from 28 November to 1 December.
