September 28 Valery Misnikov, which initially included in the PEC, and then expelled from it, was summoned to the police department of the Railway district of Viciebsk. Head of the department of law enforcement and prevention of the major human rights activist Alexander Rybakov interviewed to determine whether he has violated Article 23.5 of the Administrative Code – insulting an official in the exercise of official authority.
This article of the Code of Administrative Offences provides for a fine ranging from twenty to fifty base units.
The reason for the trial at the police station was the report of the Assistant Attorney Viciebsk Sergey Sinitski who claims that during the meeting, Valery Misnikov called it "inadequate." As we reported earlier, September 10 Valery Misnikov really visited a specially created committee in the city prosecutor's office on legal questions arising during elections where he had a conversation with Mr. Sinitski, which he interpreted as offensive.
In an interview with Major Rybakov voiced his vision of human rights case and filed a motion for the admission of the proceedings copies of explanation of the word "adequacy" and "inadequate", taken from the vocabulary of Ozhegov. He also asked to attach and a photocopy of a page from a dictionary of administrative terms, clarifying the meaning of "insult". In addition, the human rights activist demanded a linguistic examination of the words in the presence of obscene matter.
In particular, in the dictionary of Ozhegov word "inadequate" noted as a book, and there are no inappropriate values, so to speak about the insult did not have to. He says Viciebsk human rights activist and human qualities that word he was not humiliated, and assessed the professionalism and knowledge of legal official. He would only say that the employee at the time the prosecution was unable to clearly understand the meaning of Russian words and meaning of these words could not relate to the legal terms.
According to Valery Misnikov, on his part, there was no aggression, he did not argue the prosecutor's office and did what he was told. Moreover, he even tried to bring an assistant prosecutor to common sense, that is, that he kept the essence of the complaint made by the human rights activist claims.
In the words of Valery Misnikov, during the start of the administrative procedure, he will try at least a little to teach prosecutors, judges and anyone who thinks that literary words he addressed to the official, somehow can insult him, "not to ship people let the work at a time when the city and fighting organized crime is far from complete."
As a precedent, he cited an example from his past. Once he called the judge of Pervomaisky court N. Guryan "morally untidy man" and "cowardly judge". Legal proceedings were initiated. He requested a linguistic examination for the presence of these expressions obscene content. The scientists, linguists have drawn the conclusion: "content is not indecent." Case closed. That was over ten years ago – of course, times have changed and are now other people.
At the end, the police Valery Misnikov asked Major Rybakov to make a copy of the case file, which are in his possession, but he declined and said that this will be possible only after the completion of the proceedings.
