Prosecutor General's Office did not want to free to examine the complaint of the Free Trade Union of Belarus (SPB) on the violation of the rights and freedoms of workers of Połacak "Fiberglass" plant. Head of Department for Supervision of citizens' rights and freedoms Marina Popova suggested the union to pay a fee of 2 basic units - then the prosecutor general's office, perhaps deign to consider the complaint on its merits.
The complaint concerned a fine job of trade union activists rally in the city of Połacak. The workers themselves consider this fine unlawful as a picket was held in the framework of trade union activities by the decision of the governing body of collegiate union. According to the Charter of the SPB union members are required to carry out the decisions of the Council of the union, which they did.
Moreover, trade unionists say that anyone picket any damage not caused, and the Administrative Code of Belarus provides for the exemption from liability for minor violations, even if one accepts that the offense took place.
The answer to the complaint, signed by Marina Popova, designed in bureaucratic traditions. At the beginning of the letter lists the articles of the tax and administrative codes. Mrs. Popov somehow require authorization from the chairman of the trade union to represent the interests of union members as if the complaint was sent to the prosecutor's office of the trade union of the individual, even though it was printed on the letterhead of the SPB primary organization of workers of JSC "Połacak-Fiberglass".
Head of Department for Supervision of citizens' rights and freedoms Marina Popova did not take into account that there is a law on trade unions, which guarantees the right of the union to apply to the state authorities. In addition, the complaint stated the union of a violation of international obligations of the Republic of Belarus to guarantee workers' rights, the observance of which just has to follow the department of the General Prosecutor's Office.
As commented deputy chairman of St. Petersburg Nikolai Sharah, the General Prosecutor's Office could not be distinguished from a trade union appeal for supervisory review.
"They are in such a hurry to unsubscribing, they could not even read the union representative's name correctly. I do not think it's all about low-skilled prosecutors. In my opinion, this is a good example of how the public body, contained at the expense of taxpayers and is obliged to monitor the observance of their rights, does not perform its functions ", - said Nikolai Sharah.
