The Constitutional Court responded to workers of

Secretariat of the Constitutional Court did not take into consideration the complaint of workers at the place of the collective agreement Polotsk plant "Fiberglass", which, according to the complainants, contrary to the Constitution. In response, signed by the chief of the Secretariat Court Alexander Karavaj said that the collective agreement of the enterprise does not have the legal acts which are considered by the Constitutional Court.

Recall workers JSC "Polotsk-Fiberglass" filed a complaint to the Constitutional Court of Belarus on trade union discrimination on the grounds of the factory in the collective agreement. Discrimination is that workers from Belkhimprofsoyuz director can fire only with the consent of the trade union, and for the dismissal of workers from the Belarusian Free Trade Union (SPB) need only notice of the Council of the primary SPB.

Such discriminatory clause of the collective agreement is entered from January 1, 2013 on the initiative of the Director of JSC "Polotsk-Fiberglass" Nicholas Kochanowski with the tacit consent of Belkhimprofsoyuz workers , who make up more than half of the number of employees. With the help of such manipulation intimidated workers Director "Fiberglass" failed (according to SPB - in violation of the constitution and the country's international obligations) to dismiss the president of the primary plant with the Free Trade Union.

Head of the Secretariat of the Constitutional Court of Belarus Alexander Karavaj sent a written response to a work of Polotsk plant "Fiberglass" to the chairman of the Free Trade Union factory Victor Stukov. Besides information about the impossibility of examining the complaint, the chief of the Secretariat explained the working of their right to enter into collective labor dispute with the director on changes discriminatory provisions in the collective agreement.
