On August 15 Viciebsk Regional Court began to examine complaints and civil party activists on waivers of district election commissions register them as candidates for deputy of the Belarusian parliament. During the first day of the trial it was considered the complaints of two contenders for the seats in the House of Representatives, Nicholay Manohin and Sergei Vasiliev.
Both complaints were not satisfied.
So, when considering a complaint of an independent candidate from Navapołacak Nicholay Manohina, who was nominated for deputy by collecting signatures for Navapołacak constituency №24, the court had found that the applicant made a number of violations of the current legislation. The judge Alexander Fedyukevich agreed with the district election and the Viciebsk oblast election commission that Nikolay in the declaration of income and assets do not have information about the presence of the share in the authorized capital of private enterprise "Novotekh", and it was discovered more than 20% of invalid during the verification commission of signatures .
The judge ruled that all these facts are documented and are essential and legitimate for Mr. Manohin failure to register as a candidate.
However, the court did not take into account the fact that the firm "Novotekh" from 2011 is in the process of liquidation. And if so, the holder of the share in the authorized capital of the enterprise has the legal right not to indicate in the declaration of the existence of its shares.
Nikolai Manohin also presented the court with valid arguments in support of the fact that the correction of clerical errors, and in the signature sheets do not prevent voters identify the person, and, consequently, the signature of the signatories cannot be considered invalid.
Manohin drew the judge's attention to the fact that the district commission for the selection for the verification of signature sheets has selected only those sheets in which there was a large amount of corrections to voter data. Such a selection of signature sheets Nikolay considered a manifestation of bias against him on the part of the district commission. According to the failed candidate, namely the manipulation of the selection of signature sheets were one of the reasons for the refusal to register him. However, all these reasons the court has not taken into account.
The judge's decision immediately entered into force, and the appeal or protest in cassation cannot be. Thus, Nikolay Manohin finally dropped out of the race. Now he has a long four years to analyze their mistakes, pick up a reliable and responsible team signature collectors and in 2020 once again try to capture storm chair of the Belarusian Parliament.
