President of the Court of Haradok district, Vitebsk region, Alexander declined to give Leshkovich BPF activist Leanid Autukhou information on the number of residents of the area, which were sent by the court for treatment of alcohol and drug addiction in medical-labor dispensaries (LTP).
In early May, Mr. Avtukhou orally asked the president of the court Leshkovich s request to inform him about the number of persons who by court order in 2015 were sent to the LTP. President of the Court, as the true guardian of the state and official secrets, offered opposition politician to address the court in writing.
However Autukhou seemed so head of the District Court violated his constitutional right to receive information on the work of state bodies and institutions. Based on this assumption, Leonid turned to the Vitebsk regional court against the Chairman of Haradok District Court.
Chairman of the regional court Nikolai Hamichenok conducted an inspection on the complaint. After analyzing the data obtained as a result of this inspection, the chief judge of the Vitebsk region found no violations of the law in the actions of his subordinates. Justifying the action Haradok judge Hamichenok informed the complainant that access to information may be restricted by legislation for the protection of honor, dignity, private and family life of citizens and the full exercise of their rights.
At the same time Nikolai Hamichenok oppositionist still advised to turn to the head of the Haradok District Court with a written statement as required by the Law of the Republic of Belarus "On complaints of citizens and legal entities."
Assuming that the information he is interested in, is important and in the public interest, Mr. Avtukhou re-addressed to the chairman of the district court, this time with a written statement. Leonid wondered why breed bureaucracy around a simple minute business - to name, at least approximately, the number of residents of Haradok District sent to the LTP. Was this information is public or private secret?
